Digital Media Strategies Ltd. (the “site owner”) trading as Travelneon operates and administers the website at www.travelneon.com (“our website”). Our website is powered by our service provider HotelsCombined.

All references to "we/our/us" in this Terms and Conditions refer to Travelneon. All references to "you/your" or the “user” refer to a user of our website.

The trade name Travelneon including its logo are trademarks of CPR Ventures Ltd, exclusively licensed to the site owner, and must not be used in any form without the express prior written approval of the site owner.

1. Scope of Service

1.1. These Terms and Conditions govern your use of our website and all content on this website. Your use of our website and any other website operated by us is subject to these Terms and Conditions.

1.2. These Terms and Conditions are subject to occasional changes and apply to all our services that are directly or indirectly provided (i.e. via third parties) via the internet, on mobile devices, by email or by telephone.

1.2. By using our website, you confirm that you have read, understood and agree to these Terms and Conditions, as well as the privacy policy, including the use of cookies.

2. Services and Contract

2.1. Travelneon is a travel search website and offers you the ability to search for, select, and book travel-related reservations, including hotels, flights, car rentals and activities discounts with third-party suppliers. On the Travelneon website, you can compare third party services via the HotelsCombined system and other partners of Travelneon (“Partners’ system”).

2.2. Through our Partners’ system, users have the possibility of booking the selected hotel, flight, car or deal through a direct connection to third parties’ travel booking sites (“booking site” or “third party”). As a result, the booking will be made directly on the booking site and not on the Travelneon site. Therefore, Travelneon is not, and shall not be deemed, the travel operator or the contractual party for the user, but only an independent agent providing the technical connection to the booking site of a third party.

2.3. By making a booking on the website of the third party, users agree to be bound by the terms and conditions of that booking site. These terms and conditions can be viewed on the website of the third party. Once a booking is made on the website of a third party, a contract is concluded between the booking site and the user, and therefore no contract is concluded between the user and Travelneon or HotelsCombined. Travelneon is an independent contractor and is not legally related to or representant of any third party and their booking sites; and, all and any claims of the user related to their bookings are to be asserted against the third party responsible for the corresponding booking site and not against Travelneon or HotelsCombined. 

2.4. This agreement is not affected by any other agreements between travel service providers and users (such as hotels, airlines or car rental companies), between any third party and users, or between any one of them with any others, at any time.

2.4. In addition to this Terms and Conditions, users must read and understand the terms of use of HotelsCombined.

3. Privacy, Email Advertisements

3.1. The protection of personal data provided by the user is of the highest priority for Travelneon. As such, we make every effort to ensure compliance with data protection. For more information, please read our Privacy Policy.

3.2. Travelneon collects, processes and uses your personal data (hereafter “data”) only if we have obtained your consent or a statutory provision allows for the collection, processing or use of your data. 

3.3. Travelneon will only raise, process and use data necessary for the provision of the services rendered by Travelneon, for the use and operation of the websites / apps and the services offered.

3.4. If the user has agreed to receive information about Travelneon by signing up to Travelneon’s newsletter and deals alerts or at another time using Travelneon’s services, the user will receive periodic product information. The consent may be revoked by the user at any time by written communication or by email. The consent to receive emails follows after the confirmation of subscription page opens in your browser.

4. User Obligations

4.1. By using our website, you warrant that you have attained the age of 18 years.

4.2. The user guarantees not to use programmes or functions to generate automated page impressions or content on Travelneon. 

4.3. The content and information on our website (including, but not limited to, messages, data, information, text, music, sound, photos, graphics, video, maps, icons, software, code or other material), as well as the infrastructure used to provide such content and information, is proprietary to us. You agree not to otherwise modify, copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell or re-sell any information, software, products, or services obtained from or through our website.

4.4. You agree not to:

(i) use our website or its contents for any commercial purpose;

(ii) access, monitor or copy any content or information of our website using any robot, spider, scraper or other automated means or any manual process for any purpose without our express written permission;

(iv) take any action that imposes, or may impose, in our discretion, an unreasonable or disproportionately large load on our infrastructure;

(v) deep-link to any portion of our website for any purpose without our express written permission;

(vi) "frame", "mirror" or otherwise incorporate any part of our website into any other website without our prior written authorization; or

(vii) attempt to modify, translate, adapt, edit, decompile, disassemble, or reverse engineer any software programs used by Travelneon in connection with our website or services.

5. Liability

5.1. Travelneon is not liable for the accuracy, quality, completeness, reliability or credibility of content provided by booking sites. There is no advice or information from Travelneon regarding the selection of accommodations. 

5.2. All agreements that arise through this service are between the Travelneon user and the respective external booking site. Travelneon does not act as organiser or travel agency at any time. The terms and conditions of the respective organiser or travel agency apply exclusively, especially regarding the right to cancel and to withdraw. The contact for the processing of bookings and payments, as well as questions about the contract, is the respective contracting booking site. Travelneon remains uninvolved in such contractual arrangements, agreements and claims between the user and the respective external contracting booking site.

5.3. Travelneon does not verify the accuracy of content uploaded by booking sites. This content is provided by the booking sites for publication on our websites with reference to the respective hotel. Travelneon has no influence on this information (in particular images, comments, reviews, etc.). and does not claim this content as its own.

5.4. Hyperlinks, advertising banners, information about accommodations, travel destinations or providers and similar are provided by booking sites and do not represent recommendations or information from Travelneon. For technical reasons, no updating of the prices we receive from booking sites are done in real time. Therefore, it is possible that the price that appears on the booking site does not correspond to the price specified on the Travelneon sites. Travelneon does not guarantee the accuracy of information, in particular, prices and availability. 

5.5. Travelneon is not liable for technical malfunctions for which the cause is not within Travelneon’s sphere of responsibility or for damages caused by force majeure. We do not guarantee uninterrupted availability of information and may perform technical maintenance during a freely chosen time-period.

5.6. Our website will link you to booking sites or other websites that Travelneon does not operate or control. If you book a reservation with a third-party, you agree to review and be bound by the third-party's terms and conditions of purchase and site use, privacy policy, and any other rules or policies related to the third-party's site or property. Your interactions with third-parties are at your own risk. Travelneon will have no liability with respect to the acts, omissions, errors, representations, warranties, breaches or negligence of any third-party suppliers or for any personal injuries, death, property damage, or other damages or expenses resulting from your interactions with any third party.

6. Indemnification

You agree to defend and indemnify Travelneon and its affiliates and any of their officers, directors, employees and agents from and against any claims, causes of action, demands, recoveries, losses, damages, fines, penalties or other costs or expenses of any kind or nature including but not limited to reasonable legal and accounting fees, brought by third parties as a result of:

(i) your violation of any law or the rights of a third party; or

(ii) your use of our website.

7. Changes to the Terms and Conditions

We may amend or vary these Terms and Conditions at any time without notice to you. Your continued use of our website now, or following the posting of such changes, will indicate acceptance by you of the terms and conditions of our website in force at the time of your use of our website. If you disagree with any part of the Terms and Conditions, you must not use our website and services.

8. Applicable Law and Jurisdiction

These Terms & Conditions shall be interpreted, construed and enforced in accordance with English law and shall be subject to the exclusive jurisdiction of the English Courts.
